What is "uncontested divorce"?
Uncontested divorce (also known as simplified divorce or consensual divorce) refers to a procedure in which both spouses reach a complete agreement on dissolving their marriage and all related matters, without the need for a court ruling, and only require all documents to be submitted to the court for review and approval.
Applicable conditions (Ontario):
- Residency requirement: At least one spouse must have lived in Ontario for at least one year.
- Proof of marital breakdown: Usually based on the premise that the couple has been separated for a full year.
- Full Agreement: The parties have reached a written agreement on all of the following issues:
- Division of property and debts
- Child support (subject to the “Child Support Guidelines”)
- Child custody arrangements (decision-making power, visitation time)
- Spousal support (if applicable)

Step 1: Reach and sign a Separation Agreement
Before initiating divorce proceedings, it is crucial to formalize all verbal agreements into a legally binding separation agreement.

Step 2: Prepare and submit divorce application documents

Step 3: Document Delivery (Service) and Waiting Period
- If the application is made unilaterally and the other party does not object, the applicant needs to serve the documents to the spouse in accordance with the law.
- The court will then grant the spouse a statutory 30-day period to respond. Since it is an uncontested divorce, the spouse typically does not file a response at this time.
Step 4: Submit the “No-Contest Divorce Affirmation” and the final application.
After the response period ends, if the other party does not raise any objections, we will submit final documents, such as a “no-dispute divorce oath,” to the court to prove that:
- All legal procedures have been followed.
- Both parties have fulfilled their legal obligations regarding information disclosure.
- Both sides have reached an agreement on all issues.
Step 5: Court approval and the divorce decree.
- The judge will review all your documents in his office (no court appearance required). Once satisfied with all legal requirements and the accuracy of the documents, the judge will sign the Divorce Order.
- A judgment typically takes effect 31 days after it is signed, marking the formal dissolution of your marriage.
